Mediation is the process of voluntarily attempting to resolve a lawsuit using a third-party mediator. The mediator’s job is to try to facilitate negotiation and have the two parties come to an agreement. Mediation is often the quickest and most affordable way to resolve a lawsuit. Affordable
Taking a lawsuit to court can be expensive, but coming to a resolution before the trial can help you avoid those expenses altogether. Even if you don’t reach an ideal result in mediation, it’s very likely that a resolution at mediation will save you money in the long run.
Voluntary
Mediation gives power to the parties involved and reduces the chances of surprises. Since mediation is voluntary, there is no conclusion unless both parties agree. That means you can walk away if you can’t come to a resolution. Unlike arbitration, the mediator does not have the power to pick a “winner” or “loser” like in a courtroom or arbitration.
On your terms
Not only do you get to choose the mediator, you can also choose the environment. In normal circumstances, you will be in a conference room with the other party. Other times, especially when it’s a particularly contentious lawsuit, the mediator will place the parties into different rooms and the mediator will go back and forth talking to each of the parties individually. Because mediation is not a one-size-fits-all process, you can work with the opposing party and with the mediator to create a setting that is best for everyone involved.
